Lex should always be greater than Rex, and thus no one should ever be above the rules.
As for whether or not he used vulgar language you would have to read the updated article that talks about the reducing of his sentence to three days.

She could have said "Excuse me why are you on the phone?" or "Excuse me who are you talking to?" I find that the turning point of this argument. I do know why everyone is arguing about enforcing the rules of the school which I understand but there could have been better ways to treat this situation on both sides. Just don't rule out one side on the basis that "he broke a rule" thats what im saying.
So that students have them on their body for when school gets out? If his school is anything at all like mine, you're allowed to have cell phones with you, so long as they're turned off during school hours. If it's discovered turned on - even if you're not using it - it gets confiscated. Plain and simple.
Yeah, it could've been handled better by all. And perhaps an explanation by the student would've avoided the entire situation. Of course, just because nobody knows the rule's being broken doesn't make it okay.
edit: The updated story mentioned by wingrunner.
Quite a bit late after this original post, but since I have a bit more time now, I'll add that I disagree with the decision to shorten his suspension. Perhaps it is more suitable when special consideration is given, but seeing as my whole point in this case is that special consideration should NOT be granted, I'm sure you understand my problem. If any other studen, in a similar situation, finds himself with a 10-day suspension (or arrested), I can imagine a lot of trouble for that school.
